The Story

Betfred scored a £100m tax refund after the court said that the value added tax applied to revenue derived from the fixed-odds betting terminals (FOBTs) in its betting shops had breached the concept of ‘fiscal neutrality.’

The court may have given a smoking gun for the UK government.

The tribunal declared that slots games “all met the same need from the point of view of the customer,” regardless of whether they were based on an FOBT or some other delivery mechanism. The court also applied the same reasoning toward roulette, card games and virtual racing games. With the court blurring the lines between land-based electronic gaming and online games, the UK government may impose the new £2 maximum stakes on FOBTs to online slots and other casino games.
