European Union Ombudsman has dismissed the complaint filed by a group of betting operators accusing the European Commission (EC) of inaction on the protectionist rules of several EU states.

In its decision, the EU Ombudsman said that the EC “enjoys wide discretion” when it comes to deciding whether or not to pursue infringement cases, adding that the EC’s decision to drop all pending cases involving online gambling “is covered by this wide discretion.” To add insult to injury, the Ombudsman said that it lacks authority to tell EC what it can or cannot do. So basically, states could not be restrained from imposing protectionist rules that will be detrimental to gambling operators.
