The Story

The legalization of daily fantasy sports (DFS) is one step closer to reality as majority of Assembly members voted in favor of a bill regulating DFS. However, DFS legalization suffered another blow for the second consecutive year in Alabama. 

 

Brief it to me gently—bad news first.

Here you go. In Alabama, members of the Senate killed H354 after they failed to put the legislation to vote. Observers said that the Senate’s decision not to tackle the bill has something to do with State Attorney General Luther Strange’s position on DFS. Strange has earlier said that DFS is illegal as it is considered gambling under current state law.

 

Isn’t this unfair?

Union Finance Minister Arun Jaitley, who chairs the GST Council, begs to differ. Jaitley said that the 28 percent tax slab for cinema halls and casinos is just fair because entertainment and luxury taxes are already merged with service tax in GST.

 

Is there any hope yet for DFS to be legalized in Alabama?

After the DFS bill crashed and burned in the said state, supporters can only hope that the Alabama Senate could tackle the bill in a special session soon.

 

Getting the bad out of the way, give me the good news.

Certainly. Over in New Jersey, the legislation that will regulate DFS and impose a quarterly fee of 10.5 percent of gross revenues on fantasy sports providers was passed by the New Jersey Assembly, 56-15. The A3532 gives the state government regulatory power to issue permits to fantasy sports operators and put in place consumer protections that must be complied with by operators. The bill’s counterpart in the state Senate is also being tackled.

 

Takeaway

The legalization of daily fantasy sports (DFS) in the US remains an uphill battle with these developments from New Jersey and Alabama.
