The Story

The dream of legalizing sports betting in the US seems to have been dashed by the US Supreme Court (SC) after the New Jersey’s challenge against federal sports betting prohibition was not on the Court’s list of cases that it will hear for its 2017 term. 

 

Let’s go back to the start.

New Jersey has sought to legalize sports betting since 2011 when it passed legislation authorizing sports betting at select licensed gaming venues. However, this was opposed by various groups, saying that it violated the 1992 Professional and Amateur Sports Protection Act (PASPA).

 

What’s PASPA?

PASPA restricts legal single-game sports betting to Nevada, while allowing parlay-style wagering in three other states. New Jersey’s attorneys said that PASPA unfairly prevents states from choosing how to enforce gambling laws within their respective borders. Two unsuccessful betting bills later, New Jersey has raised the challenge on the PASPA to the Supreme Court.

 

But there’s a silver lining.

While New Jersey’s case doesn’t appear on the Court’s list of cases it intends to hear, it also doesn’t appear on the much larger list of petitions that the Court has explicitly rejected. Thus, there is still the possibility that the Court could address the issue via a supplemental “miscellaneous order.”

 

Takeaway

The legal challenge against federal sports betting prohibition of New Jersey in the Supreme Court is still alive, yet it remains to be seen whether the SC would rule in the state’s favor this time.
