The Story

Absolute Poker’s (AP) Scott Tom has agreed to forfeit $300,000 as part of his Black Friday plea deal with US federal prosecutors.

 

Why does he need to forfeit $300k?

Tom’s plea deal requires him to forfeit $300k, as it represents “the amount of proceeds traceable to the offense” to which Tom pled guilty. The charge covers Tom’s illegal gambling activity between October 2007 to “in or about 2009.”

 

Tom reached a deal last May with the feds.

On May 31, Tom reached a deal with prosecutors that saw him plead guilty to a single misdemeanor of being an accessory after the fact in the transmission of gambling information. His plea agreement allows a “two-level reduction” in the base offense level of Tom’s crimes if his allocution and subsequent conduct prior to sentencing demonstrates his “acceptance of responsibility” for his actions.

 

Which means?

The two level reduction will lower his potential prison time to between zero and six months, while the allowable fine range is between $250 and $5k. It is likely that Tom will be spared a custodial sentence.

 

Takeaway

Tom is one step closer to freedom as he accomplishes the terms of the plea agreement. However, it is unfortunate that Tom and other top executives at AP did not receive a reckoning over the ways they cheated out millions of dollars from their players.
