New York sports gambling fans woke up to news of an appeals court siding with a lower court’s decision that daily fantasy sports (DFS) is pure chance and that the activity shouldn’t be authorized.

The Story
A highly contested decision in 2016 that authorized the New York gaming commission to issue temporary permits for sports gambling companies to get into daily fantasy sports (DFS) is in peril as an appeals court has now sided with a lower court’s judgment that the state legislature couldn’t authorize such activity. The courts see DFS as pure luck and not a skill, which is bad news for DraftKings, FanDuel, Yahoo, FantasyDraft and Draft -- the five companies who had been issued the temporary DFS licenses. New York lawmakers still support DFS as a type of sports gambling and will most likely back any effort to seek an appeal. However, some states have already decided that the practice doesn’t have a place in their gambling plans. DFS is currently prohibited in Arizona, Idaho, Montana, Nevada and Oregon.
