Samsung seeks revenge with sales ban on iPhone

samsung apple newsIt won’t be long before the iPhone 5 hits the market, but in the meantime, Samsung is doing everything in it’s legal power to try and stop it, or at least delay it.

Samsung’s legal team told the Korea Times that it’s already working on a national sales ban against the iPhone 5. Hands up if you think Samsung has a chance in hell of getting that to go over. I doubt if Apple is even wincing at this.

However, let’s humor ourselves for a moment and let’s just imagine if a Korean court actually granted Samsung the injunction. It would require the court to ignore all the previous rulings and set a new precedent with a ruling that the iPhone has in fact infringed upon the Samsung patents. This is a battle that has already been lost, Samsung has never been able to prove its case before judges in any court in any corner of the world, and that trend is unlikely to change with the iPhone 5.

You can’t fault Samsung for taking the gloves off though. The company must still be fuming over how Apple managed to one up them by gaining a preliminary injunction to stop sales of Samsung’s Galaxy Tab 10.1 across the entire European Union on the basis of patent infringement. Samsung also lost ground to Apple in Australia where it was barred from selling its tablet for patent infringement.

Will they get their revenge with a sales ban against the iPhone 5? Probably not, but this fight between Samsung and Apple gets better by the day, even if Apple is pointing to the scoreboard.
